2. About Bookort

Bookort is a Philippine court booking and player matchmaking platform for badminton, pickleball, and tennis. We are currently in pre-launch, onboarding our first partner venues in Davao City.

3. Acceptance of Terms

By downloading, installing, or using Bookort, you agree to be bound by these Terms of Service and End User License Agreement ("Terms"). If you do not agree, do not use Bookort.

These Terms form a binding agreement between you and [LEGAL ENTITY NAME] ("Bookort," "we," "our," or "us"), a corporation registered in the Philippines.

We may update these terms from time to time. We'll notify you by email and in-app banner at least 14 days before material changes take effect. Continued use after the effective date means you accept the updated terms.

4. Eligibility

You must be at least 18 years old to use Bookort. By using the app, you confirm that you are 18 or older. If you are accessing Bookort on behalf of a business (e.g., as a venue partner's administrator), you confirm that you have authority to bind that business to these Terms.

5. The Bookort Platform

What Bookort is: An online marketplace that connects players looking to book sports courts (pickleball, badminton, tennis) with venue partners who list their courts on our platform. Bookort also provides a player matchmaking service that suggests playing partners based on skill level, location, and preferences.

What Bookort is not: Bookort is not a court operator. We do not own or manage the courts listed on the platform. The service is delivered by independent venue partners. Bookort is not liable for the condition, quality, safety, or availability of courts managed by venue partners.

Venue partner information: Each venue partner's name, address, and contact information is displayed on their Bookort profile page. Venue partners are required to hold valid business permits and barangay clearances for their facilities.

6. Booking a Court

When you book a court on Bookort:

1. You select a court, date, and time slot
2. Before confirming payment, you will see: the exact court, venue, date, time, total price including all fees, and a link to our Cancellation Policy
3. You confirm payment — at this point, your booking is confirmed
4. You receive an in-app confirmation and SMS notification

Payment: Bookort accepts payment via GCash, Maya, and credit/debit card. Payments are processed by Xendit Payments Philippines, Inc. By completing a payment, you agree to Xendit's Terms and Conditions.

Fees: The price shown before you confirm is the total price you pay. There are no hidden fees added after checkout. If Bookort charges a convenience fee, it will be explicitly displayed as a separate line item before checkout confirmation.

Booking holds: 8 minutes for GCash or card, 20 minutes for group bookings. Max 1 active hold per account at a time.

Booking confirmation: Your booking is confirmed when you receive an in-app confirmation message. Confirmed bookings are binding on both you and the venue partner.

7. Cancellation and Refund Policy

Under RA 7394 (Consumer Act of the Philippines), you have the right to a refund when a service is not rendered as described. The following policy governs all cancellations:

Player-Initiated Cancellations

Bookort Credits do not expire and can be used for any future booking.

How to cancel: Open the booking in the Bookort app → tap "Cancel Booking" → confirm. Cancellations must be made through the app to be recorded with an accurate timestamp.

Processing time: Approved cash refunds are processed within 3–5 business days to your original payment method.

Venue-Initiated Cancellations:

If a venue partner cancels your confirmed booking:

• You receive a 100% cash refund within 3 business days, regardless of lead time
• You also receive Bookort Credits equal to 50% of the booking value as compensation for the inconvenience

Service Failure Refunds:

You are entitled to a 100% cash refund in the following circumstances:

• The court was listed as available but the venue could not accommodate you on arrival
• The court was in a condition that made it unplayable (your safety was at risk)
• A confirmed match player failed to appear and Bookort cannot provide an alternative
• A technical error caused double-billing or payment without a booking

To claim a service failure refund, report the issue in the app within 24 hours of the scheduled session. We will review and decide within 7 calendar days.

8. Matchmaking Service

Bookort's matchmaking feature suggests playing partners based on skill rating, location, sport preferences, and availability. Matchmaking is a recommendation service — we do not guarantee that suggested matches will be available, will accept your invitation, or will meet your expectations.

Bookort is not liable for the behavior, skill level representation, or conduct of matched players.

9. Acceptable Use

You agree not to:

• Create a false profile or misrepresent your skill level to gain unfair advantages in matchmaking
• Book courts with no intention of attending (court hoarding)
• Harass, threaten, or discriminate against other users or venue staff
• Use Bookort to conduct any illegal activity
• Attempt to reverse engineer, decompile, or extract the source code of the app
• Scrape, copy, or redistribute Bookort's court listings, player data, or pricing information
• Use automated scripts, bots, or tools to interact with the platform

We reserve the right to suspend accounts that violate these rules, with or without prior notice, depending on the severity of the violation.

10. User-Generated Content

You retain ownership of content you post on Bookort (profile photos, venue reviews, match comments).

By posting content, you grant Bookort a worldwide, royalty-free, non-exclusive, sublicensable license to use, display, reproduce, and distribute that content within the Bookort platform for the purpose of operating the service.

You warrant that your content does not infringe any third party's intellectual property rights and does not violate any applicable law.

We may remove content that violates these Terms, applicable law, or our community guidelines, without prior notice.

11. Venue Partners

Venue partners listed on Bookort are independent businesses. They are not employees or agents of Bookort. Bookort does not control the physical facilities, court maintenance, safety standards, or staffing decisions of venue partners.

Bookort requires venue partners to hold valid business permits and to warrant that their courts are in safe, playable condition. However, Bookort cannot independently verify these conditions at all times. You use venue partner facilities at your own physical risk.

12. Privacy

Your use of Bookort is governed by our Privacy Policy, which is incorporated into these Terms. Please read the Privacy Policy carefully.

13. Intellectual Property and Software License

Bookort's intellectual property: All software, design, algorithms, trademarks, logos, text, graphics, and content in the Bookort app (other than user-generated content and venue-provided photos) are owned by [LEGAL ENTITY NAME] and protected by Philippine copyright law (RA 8293) and international IP conventions.

Your license: Subject to your compliance with these Terms, Bookort grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Bookort app on your personal mobile device solely for its intended purpose.

You may not:

• Copy, modify, or distribute the app
• Reverse engineer, decompile, or disassemble the app
• Rent, sell, or sublicense access to the app
• Remove any copyright, trademark, or other proprietary notices

14. Disputes Between Users

If you have a dispute with a venue partner or another player, we encourage you to resolve it directly first. If you cannot, submit a dispute through the in-app "Report a Problem" function.

Bookort's internal redress process (RA 11967 compliant):

1. Submit your complaint through the app (Settings → Help → Report a Problem)
2. We will acknowledge your complaint within 2 business hours for urgent issues (ongoing booking problems) and 24 hours for standard issues
3. We will investigate and provide a decision within 7 calendar days
4. If you are unsatisfied with our decision, you may escalate to the Department of Trade and Industry (DTI) via the Online Consumer Assistance Desk at consumercare.dti.gov.ph within 2 years of the transaction

15. Limitation of Liability

To the maximum extent permitted by Philippine law, Bookort's total liability to you for any claim arising out of or related to these Terms or your use of the platform shall not exceed the total amount you paid to Bookort in the three (3) months preceding the claim.

Bookort shall not be liable for:

• Indirect, incidental, special, consequential, or exemplary damages
• Loss of profits, data, business opportunities, or goodwill
• The physical condition or safety standards of venue partner facilities
• The behavior, skill level, or conduct of other users
• Disruptions caused by internet connectivity, third-party payment systems, or force majeure events

Nothing in these Terms limits Bookort's liability for:

• Fraud or willful misconduct
• Death or personal injury caused by Bookort's gross negligence
• Any liability that cannot be excluded or limited under Philippine law

16. Indemnification

You agree to indemnify and hold Bookort harmless from any claims, damages, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your use of the platform
• Your interactions with other users or venue partners
• Any content you post on the platform

17. Disclaimers

THE BOOKORT PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKORT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Bookort does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

18. EULA — Apple App Store and Google Play

For users who downloaded Bookort from the Apple App Store:

This license is between you and Bookort only, not with Apple Inc. Apple is not responsible for Bookort or its content. Your license to use Bookort is limited to a non-transferable license to use the app on any Apple-branded products you own or control, subject to the App Store Terms of Service.

• Maintenance and support: Bookort is solely responsible for providing maintenance and support. Apple has no obligation to provide any maintenance or support.
• Warranty: To the extent any warranty applies and if Bookort fails to conform, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Product claims: Bookort, not Apple, is responsible for addressing product liability claims, consumer protection claims, and third-party IP infringement claims.
• Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
• In-app purchases on iOS: Physical court bookings (real-world services) are processed through Xendit and are not subject to Apple's billing policies.

For users who downloaded Bookort from Google Play:

This license is between you and Bookort only, not with Google LLC. Court bookings and related real-world services are processed through Xendit. Any digital features purchased through Google Play's billing system are subject to Google Play's Terms of Service.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of the Philippines. Any dispute not resolved through our internal redress process shall be subject to the exclusive jurisdiction of the courts of [INSERT CITY], Philippines.

20. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification and email at least 14 days before the new Terms take effect. Continued use of Bookort after the effective date constitutes your acceptance of the updated Terms.
